Question:
1) are budgie poop impure?
2) does one have to wash or change their clothes before salah or will
removing the poop simply suffice? What if the poop goes on your rug or
sofa etc?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, the ruling of the bird droppings is dependent upon whether the bird can be consumed or not.
The following few principles help ascertain the ruling of different birds:

  • Birds that hunt with their talons or claws are impermissible to consume such as eagles and falcons.
  • Birds that use their beaks or bills to catch prey (fish etc.) such as storks and pelican are permissible to consume.[1]
  • Birds whose diets consist solely of carrion or filth such as vultures and certain crows are impermissible to consume.
  • Birds whose diets consist of both carrion/filth AND seeds/birdfeed will be permissible to consume such as certain chickens and crows. However, if the foul diet causes the meat to smell bad and repugnant, it will be makruh to consume.
  • Birds whose diets solely consist of seeds/grains and birdfeed etc. (no carrion or filth) will be permissible to consume such as certain chickens and crows.[2]

Budgies or the budgerigars are seed-eating birds.[3]  Hence, budgies are lawful and ḥalāl birds for consumption.[4]  Therefore, the droppings of budgies are pure and do not have to be removed in order to perform ṣalāh.  However, it is ideal to be as clean as possible when performing ṣalāḥ.  Thus, it would be better to remove the stains from one’s clothing before performing ṣalāh.

[1]  وَمَا لَا مِخْلَبَ لَهُ مِنْ الطَّيْرِ فَالْمُسْتَأْنِسُ مِنْهُ كَالدَّجَاجِ وَالْبَطِّ وَالْمُتَوَحِّشُ كَالْحَمَامِ وَالْفَاخِتَةِ وَالْعَصَافِيرِ والقبج وَالْكُرْكِيِّ وَالْغُرَابِ الَّذِي يَأْكُلُ الْحَبَّ وَالزَّرْعَ وَالْعَقْعَقِ وَنَحْوِهَا حَلَالٌ بِالْإِجْمَاعِ (بدائع الصنائع ، ج5، ص39، دار الكتب العلمية)

[2]  وَلَا بَأْسَ بِغُرَابِ الزَّرْعِ؛ لِأَنَّهُ يَأْكُلُ الْحَبَّ وَالزَّرْعَ وَلَا يَأْكُلُ الْجِيَفَ هَكَذَا رَوَى بِشْرُ بْنُ الْوَلِيدِ عَنْ أَبِي يُوسُفَ قَالَ: سَأَلْتُ أَبَا حَنِيفَةَ – عَلَيْهِ الرَّحْمَةُ – عَنْ أَكْلِ الْغُرَابِ فَرَخَّصَ فِي غُرَابِ الزَّرْعِ وَكَرِهَ الْغُدَافَ فَسَأَلْتُهُ عَنْ الْأَبْقَعِ فَكَرِهَ ذَلِكَ.

وَإِنْ كَانَ غُرَابًا يَخْلِطُ فَيَأْكُلُ الْجِيَفَ وَيَأْكُلُ الْحَبَّ لَا يُكْرَهُ فِي قَوْلِ أَبِي حَنِيفَةَ عَلَيْهِ الرَّحْمَةُ قَالَ: وَإِنَّمَا يُكْرَهُ مِنْ الطَّيْرِ مَا لَا يَأْكُلُ إلَّا الْجِيَفَ.

وَلَا بَأْسَ بِالْعَقْعَقِ؛ لِأَنَّهُ لَيْسَ بِذِي مِخْلَبٍ وَلَا مِنْ الطَّيْرِ الَّذِي لَا يَأْكُلُ إلَّا الْحَبَّ كَذَا رَوَى أَبُو يُوسُفَ أَنَّهُ قَالَ: سَأَلْتُ أَبَا حَنِيفَةَ – رَحِمَهُ اللَّهُ – فِي أَكْلِ الْعَقْعَقِ فَقَالَ: لَا بَأْسَ بِهِ، فَقُلْت: إنَّهُ يَأْكُلُ الْجِيَفَ فَقَالَ: إنَّهُ يَخْلِطُ.

فَحَصَلَ مِنْ قَوْلِ أَبِي حَنِيفَةَ أَنَّ مَا يَخْلِطُ مِنْ الطُّيُورِ لَا يُكْرَهُ أَكْلُهُ كَالدَّجَاجِ، وَقَالَ أَبُو يُوسُفَ – رَحِمَهُ اللَّهُ -: يُكْرَهُ؛ لِأَنَّ غَالِبَ أَكْلِهِ الْجِيَفُ.

فَكَانَ الْأَصْلُ عِنْدَهُ أَنَّ ما يَخْلِطُ كَالدَّجَاجِ لَا بَأْسَ وقال أبو يُوسُفَ رَحِمَهُ اللَّهُ تَعَالَى يُكْرَهُ الْعَقْعَقُ كما تُكْرَهُ الدَّجَاجَةُ كَذَا في فَتَاوَى قَاضِيخَانْ

قَالَ فِي الْعِنَايَةِ: وَأَمَّا الْغُرَابُ الْأَبْقَعُ وَالْأَسْوَدُ فَهُوَ أَنْوَاعٌ ثَلَاثَةٌ: نَوْعٌ يَلْتَقِطُ الْحَبَّ وَلَا يَأْكُلُ الْجِيَفَ وَلَيْسَ بِمَكْرُوهٍ. وَنَوْعٌ لَا يَأْكُلُ إلَّا الْجِيَفَ وَهُوَ الَّذِي سَمَّاهُ الْمُصَنِّفُ الْأَبْقَعَ وَإِنَّهُ مَكْرُوهٌ. وَنَوْعٌ يَخْلِطُ يَأْكُلُ الْحَبَّ مَرَّةً وَالْجِيَفَ أُخْرَى وَلَمْ يَذْكُرْهُ فِي الْكِتَابِ، وَهُوَ غَيْرُ مَكْرُوهٍ عِنْدَهُ مَكْرُوهٌ عِنْدَ أَبِي يُوسُفَ اهـ وَالْأَخِيرُ هُوَ الْعَقْعَقُ كَمَا فِي الْمِنَحِ وَسَيَأْتِي
