Question:

If a man and woman appoint the same person to be the representative of both? So this one vakeel would do the ijaab and the qabul in front of two physical present witnesses and the bride and groom watch them over a video call, would this be permissible?

The Fatwa

In the Name of Allah, the Most Gracious, the Most Merciful

The Answer

The appointment of a single representative (wakīl) to conduct the marriage contract (Nikāḥ) on behalf of both parties amidst two male Muslim witnesses or one male and two female witnesses is deemed permissible. Once the contract (‘aqd) is executed, the marriage becomes valid and binding.

The Fiqh of The Answer

The legitimacy of appointing a single representative for both parties is agreed upon by the Imams of the Madhhab. It is agreed upon that an individual can act as a representative for one or both sides of the marriage contract. This consensus extends to scenarios where the representative is appointed by both parties, ensuring that the contract is valid and binding.

The concept of representation (wakālah) in fiqh allows for flexibility in contractual marriage arrangements. While traditional practices involve representation solely for the bride with the groom being present and representing himself, the jurists (Fuqahā’) affirm the acceptability of appointing a single or dual representatives for both parties (bride and groom).

The Fuqahā’ refer to representation in marriage (wakīl fi al-nikāḥ) as a mere facilitator (safīr/mu’abbir). The representative ensures that the contract is executed properly on behalf of both parties, without directly assuming rights and obligations.

In light of this, it is established that a single individual can indeed serve as a representative for both parties in a marriage contract without any hindrance. The representative can conduct the necessary proceedings, such as the offer (ījāb) and acceptance (qabūl), in the presence of two physically present witnesses, while the bride and groom observe the proceedings via video call.
