Question:

Is it permissible to consume medication that are in gelatine capsules? [Question Published as Received]

The Fatwa

In the Name of Allah, the Most Gracious, the Most Merciful

The Answer

Gelatine has been considered harām according to the majority of scholars unless it is from a vegetarian (or halal-slaughtered) source. The Fuqaha (jurists) state that it will only be permissible to use medication with harām ingredients when a sound doctor gives advice that this is the only medication which will be effective and there is no other alternative available. With regards to capsules you may transfer the contents of the capsule to a vegetarian capsule at the instruction of medical professional or you may swallow the contents removing the capsule if deemed safe. If these options are considered safe and effective, consumption of the capsule will not be permitted.

The Fiqh of the Answer

If gelatine is extracted from prohibited sources such as pork or the non-Islamically slaughtered hides and bones of cattle, it is commonly agreed that if a complete transformation occurs during the gelatine manufacturing process, the gelatine becomes permissible and can be consumed.

However, the question arises: Does a complete transformation truly take place? While some scholars argue that a complete transformation occurs during gelatine manufacturing, thereby rendering the end product permissible despite its original haram nature, the majority of scholars hold the opinion that such a transformation does not occur. Consequently, they deem gelatine derived from haram sources to be unacceptable for consumption. This is also the view and position held by Mufti Taqī Uthmānī and Mufti Radhāul Haq hafiżahumallāh.

The overarching principle concerning impure and prohibited substances is their impermissibility of use, even for medicinal purposes. However, within the Hanafi school of thought, a number of jurists have established specific conditions under which this prohibition may be relaxed:

1} It must be reasonably established that the medical treatment in question will be effective and is necessary.

2} There must be no permissible alternative available that can reasonably fulfill the required medical purpose.

3} These conditions must be verified by a knowledgeable muslim physician who, at the very least, exhibits outward signs of uprightness and piety.

In this manner, the Hanafi jurists such as Ibn Nujaym Al Miṣrī, ‘Allāmah ‘Aynī, Ibn Māzah Al Bukhārī and Haṣkafī amongst others have outlined a framework that allows for exceptions to the general ruling, permitting the use of impure or Haram substances in specific circumstances based on the aforementioned conditions, all of which must be carefully evaluated under the guidance of a competent and devout Muslim medical professional.
