Question:

Is it permissible to recite Surah Fatiha as a dua in the state of Haydh?

The Fatwa

In the Name of Allah, the Most Gracious, the Most Merciful

The Answer

It is permissible to recite Sūrah  al-Fātiḥaḥ during menses with the intention of Du’ā’. 

The Fiqh of the Answer

‘Allāmāh Ibn ‘Abīdīn Shāmī (d.1252 AH) paraphrasing Imām al-Hudā, Abū Layth as-Samarqandī (d.373 AH) states that it is acceptable for a menstruating women to read the Fātiḥah or any other excerpt of the Qur’ān wherein the connotation of du’ā’ is found.

Therefore, the entire Al Fātiḥah or any other singular verse(s) or chapter from the Qur’ān can be read with the intention of du’ā’, provided the verses comprise the words (Alfāẓ) and meanings (Ma’ānī) indicative of supplication.

يَمْنَعُ الْحَيْضُ قِرَاءَةَ الْقُرْآنِ وَكَذَا الْجَنَابَةُ لِقَوْلِهِ – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – «لَا تَقْرَأْ الْحَائِضُ وَلَا الْجُنُبُ شَيْئًا مِنْ الْقُرْآنِ» رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَهْ وَحَسَّنَهُ الْمُنْذِرِيُّ وَصَحَّحَهُ النَّوَوِيُّ

أَمَّا إذَا قَرَأَهُ عَلَى قَصْدِ الثَّنَاءِ أَوْ افْتِتَاحِ أَمْرٍ لَا يُمْنَعُ فِي أَصَحِّ الرِّوَايَاتِ وَفِي التَّسْمِيَةِ اتِّفَاقٌ أَنَّهُ لَا يُمْنَعُ إذَا كَانَ عَلَى قَصْدِ الثَّنَاءِ أَوْ افْتِتَاحِ أَمْرٍ كَذَا فِي الْخُلَاصَةِ وَفِي الْعُيُونِ لِأَبِي اللَّيْثِ وَلَوْ أَنَّهُ قَرَأَ الْفَاتِحَةَ عَلَى سَبِيلِ الدُّعَاءِ أَوْ شَيْئًا مِنْ الْآيَاتِ الَّتِي فِيهَا مَعْنَى الدُّعَاءِ وَلَمْ يُرِدْ بِهِ الْقِرَاءَةَ فَلَا بَأْسَ بِهِ اهـ (البحر الرائق شرح كنز الدقائق ج 1 ص209 دار الكتاب الإسلامي)

فَلَوْ قَرَأَتْ الْفَاتِحَةَ عَلَى وَجْهِ الدُّعَاءِ أَوْ شَيْئًا مِنْ الْآيَاتِ الَّتِي فِيهَا مَعْنَى الدُّعَاءِ وَلَمْ تُرِدْ الْقِرَاءَةَ لَا بَأْسَ بِهِ كَمَا قَدَّمْنَاهُ عَنْ الْعُيُونِ لِأَبِي اللَّيْثِ وَأَنَّ مَفْهُومَهُ أَنَّ مَا لَيْسَ فِيهِ مَعْنَى الدُّعَاءِ كَسُورَةِ أَبِي لَهَبٍ لَا يُؤَثِّرُ فِيهِ قَصْدُ غَيْرِ الْقُرْآنِيَّةِ

وَأَمَّا إذَا قَرَأَهُ عَلَى قَصْدِ الذِّكْرِ وَالثَّنَاءِ نَحْوَ {بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ} [الفاتحة: 1] أَوْ {الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ} [الفاتحة: 2] أَوْ عَلَّمَ الْقُرْآنَ حَرْفًا حَرْفًا فَلَا بَأْسَ بِهِ بِالِاتِّفَاقِ (تبيين الحقائق شرح كنز الدقائق ج 1 ص 57 المطبعة الكبرى الأميرية – بولاق)
