Question:

Is jus-roll puff pastry halal to use? It has alcohol in it? [Question published as received.]

The Fatwa

In the Name of Allah, the Most Gracious, the Most Merciful

The Answer

The Jus-Rol puff pastry is permissible to consume. 

The Fiqh of the Answer

The alcohol that is deemed impermissible in totality, regardless of its effects or amounts, is that which is derived from dates and grapes. This can be termed as Khamr. Alcohol derived from barley, wheat, and other ingredients are permissible to consume in a non-intoxicating amount according to Imām Abū Hanifa (d. 150 AH) and Imām Abū Yusuf (d.181 AH).

The permissibility of non-Khamr alcohol used in conventional industries and products is acceptable if:

  • They are not used as intoxicants
  • They must not be consumed to the extent of intoxication
  • They are not used in vain and in a manner that will lead to sin.

(قال – رَحِمَهُ اللَّهُ -: ونبيذ العسل والتين ونبيذ الحنطة والذرة والشعير حلال وإن لم يطبخ) ش: أي قال القدوري في ” مختصره ” م: (وهذا) ش: أي قوله حلال م: (عند أبي حنيفة وأبي يوسف -رحمهما الله – إذا كان من غير لهو وطرب) ش: قيد بهذا القيد لأنه إذا شرب لأجل اللهو، والطرب يحرم بالاتفاق (البناية شرح الهداية)

وَأَمَّا الْأَشْرِبَةُ الْمُتَّخَذَةُ مِنْ الشَّعِيرِ أَوْ الذُّرَةِ أَوْ التُّفَّاحِ أَوْ الْعَسَلِ إذَا اشْتَدَّ، وَهُوَ مَطْبُوخٌ أَوْ غَيْرُ مَطْبُوخٍ فَإِنَّهُ يَجُوزُ شُرْبُهُ مَا دُونَ السَّكَرِ عِنْدَ أَبِي حَنِيفَةَ وَأَبِي يُوسُفَ – رَحِمَهُمَا اللَّهُ تَعَالَى (فتاوى الهندية)

قَالَ – رَحِمَهُ اللَّهُ – (الشَّرَابُ مَا يُسْكِرُ) هَذَا فِي اصْطِلَاحِ الْفُقَهَاءِ لِقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – «كُلُّ مُسْكِرٍ حَرَامٌ» وَهَذَا مَعْنَاهُ.

قَالَ – رَحِمَهُ اللَّهُ – (وَالْمُحَرَّمُ مِنْهَا أَرْبَعَةٌ: الْخَمْرُ وَهِيَ النِّيءُ مِنْ مَاءِ الْعِنَبِ إذَا غَلَى وَاشْتَدَّ وَقَذَفَ بِالزَّبَدِ وَحَرُمَ قَلِيلُهَا وَكَثِيرُهَا) وَقَالَ بَعْضُهُمْ كُلُّ مُسْكِرٍ خَمْرٌ لِقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – «كُلُّ مُسْكِرٍ خَمْرٌ» رَوَاهُ مُسْلِمٌ وَلِقَوْلِهِ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – «الْخَمْرُ مِنْ هَاتَيْنِ النَّخْلَةِ وَالْعِنَبَةِ» رَوَاهُ مُسْلِمٌ، وَأَبُو دَاوُد وَلِأَنَّهَا سُمِّيَتْ خَمْرًا لِمُخَامَرَةِ الْعَقْلِ وَكُلُّ مُسْكِرٍ يُخَامِرُ الْعَقْلَ وَلَنَا إجْمَاعُ أَهْلِ اللُّغَةِ عَلَى حَقِيقَتِهِ فِي النِّيءِ مِنْ مَاءِ الْعِنَبِ وَتَسْمِيَةِ غَيْرِهَا بِالْخَمْرِ مَجَازًا وَعَلَيْهِ يُحْمَلُ الْحَدِيثُ الْمُتَقَدِّمُ كَذَا فِي الشَّارِحِ وَفِيهِ نَظَرٌ؛ لِأَنَّهُ نُقِلَ فِي الْقَامُوسِ: الْخَمْرُ مَا يُسْكِرُ مِنْ عَصِيرِ الْعِنَبِ أَوْ عَامٌّ قَالَ: وَالْعُمُومُ أَصَحُّ وَأَيْضًا الْحَدِيثُ مَحْمُولٌ عَلَى بَيَانِ الْحُكْمِ؛ لِأَنَّهُ – عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ – بُعِثَ لِبَيَانِ الْأَحْكَامِ لَا لِبَيَانِ الْحَقِيقَةِ اللُّغَوِيَّةِ وَالتَّعْرِيفُ الْمَذْكُورُ لِلْخَمْرِ هُوَ قَوْلُ الْإِمَامِ وَعِنْدَهُمَا إذَا اشْتَدَّ صَارَ خَمْرًا وَلَا يُشْتَرَطُ فِيهِ الْقَذْفُ بِالزَّبَدِ؛ لِأَنَّ اللَّذَّةَ تَحْصُلُ بِهِ وَهُوَ الْمُؤَثِّرُ فِي إيقَاعِ الْعَدَاوَةِ وَالصَّدِّ عَنْ الصَّلَاةِ وَلَهُ أَنَّ الْغَلَيَانَ بِدَايَةُ الشِّدَّةِ، وَكَمَالُهُ بِقَذْفِ الزَّبَدِ (البحر الرائق شرح كنز الدقائق )

وَيجوز بَيْعه وتمليكه وَيضمن متلفه وَهَذَا فِي قَول أبي حنيفَة وَأبي يُوسُف وَعَن مُحَمَّد رِوَايَتَانِ فِي رِوَايَة أَنه حرَام شربه لَكِن لَا يجب الْحَد مَا لم يسكر وَهُوَ قَول الشَّافِعِي

وَفِي رِوَايَة قَالَ لَا أحرمهُ وَلَكِن لَا أشْرب مِنْهُ وَالصَّحِيح قَوْلهمَا بِاتِّفَاق عَامَّة الصَّحَابَة على إِبَاحَة شربه حَتَّى إِن عِنْد أبي حنيفَة هَذَا من عَلامَة مَذْهَب السّنة وَالْجَمَاعَة حَتَّى سُئِلَ عَنْهَا فَقَالَ السّنة أَن تفضل الشَّيْخَيْنِ وتحب الختنين إِلَى أَن قَالَ وَلَا تحرم نَبِيذ الْجَرّ ثمَّ مَا سوى هَذِه الْأَشْرِبَة مِمَّا يتَّخذ من الْحِنْطَة وَالشعِير والذرة وَالسكر والفانيذ وَالْعَسَل والتين فَهِيَ مُبَاحَة وَإِن سكر مِنْهَا وَلَا حد على من سكر مِنْهَا هَذَا هُوَ الصَّحِيح من الرِّوَايَة لِأَن هَذِه من جملَة الْأَطْعِمَة وَلَا عِبْرَة بالسكر (تحفة الفقهاء)

قَالَ الْخمر حرَام قليلها وكثيرها وَالسكر وَهُوَ الَّتِي من مَاء التَّمْر ونقيع الزَّبِيب إِذا اشْتَدَّ حرَام مَكْرُوه والطلا وَهُوَ الَّذِي ذهب أقل من ثُلثَيْهِ من مَاء الْعِنَب وَمَا سوى ذَلِك من الْأَشْرِبَة فَلَا بَأْس بِهِ وَقَالَ أَبُو يُوسُف (رَحمَه الله) مَا كَانَ من الْأَشْرِبَة يبْقى بعد عشرَة أَيَّام فَإِنِّي أكرهه وَهُوَ قَول مُحَمَّد (رَحمَه الله) وَأما الأوعية فَلَا تحل شَيْئا وَلَا تحرمه فِي قَوْلهم جَمِيعًا وَقَالَ مُحَمَّد (رَحمَه الله) رَجَعَ أَبُو يُوسُف (رَحمَه الله) عَن ذَلِك إِلَى قَول أَبى حنيفَة رَضِي الله عَنه (الجامع الصغير وشرحه النافع الكبير)

Q: Does your pastry contain alcohol?

A: The majority of our products contain trace amounts or less than 1% alcohol, which burns off during the baking process. Our Filo Sheets, Chilled all Butter Puff Pastry blocks, Frozen Puff and Shortcrust blocks do not contain any alcohol.

Q: How do you extract the alcohol used in the pastry?

A: Neutral ethyl alcohol (Ethanol) is produced from the yeast fermentation of agricultural substrates (Sugar beet or wheat) followed by a distillation and a rectification.

Q: Where does the alcohol in your pastry come from?

A: The alcohol used in our pastry products is derived from ‘Sugar Beet’ or ‘Wheat’.
