The Answer
The Fiqh of the Answer
Since CBD (Cannabidiol) is non-intoxicating and distinct from THC, which is the psychoactive component of cannabis, it does not fall directly under the prohibition of intoxicants found in the divine sources. The Sharīʿah principles regarding medication are as follows:
- Medication must be Ḥalāl. When faced with dire necessity and potential life-threatening circumstances, there may be a concession to use substances that are otherwise not permitted to ingest. In such situations, ingredients typically considered impermissible may be allowed. As per the guidance of our scholarly traditions, seeking consultation with a knowledgeable Mufti and sound medical advice is vital to determine the medication’s permissibility in these contexts.
Al-Sighnāqī (d.711 AH), the author of al-Nihāyah, citing the Dhakhīrah, elaborates on the conditions for using non-Ḥalāl medication. He states that first, there should not be a Ḥalāl substitute or alternative available. Second, the medication must be thoroughly tested, with its efficacy proven. Building on this, Shaykhī Zādah (d.1078 AH) adds a third stipulation: Such medication must be prescribed by a reputable Muslim physician.
- The principle of avoiding harmful substances is emphasised, with jurists cautioning against consumption that may lead to adverse health effects, as indicated by references to ailments.
Al-Rāzī (d.666 AH) in Tuḥfat al-Mulūk that the consumption of soil or similar materials have been rendered severely disliked. The reasoning that jurists give is that such consumption is harmful.
- Before utilising any medication, seeking advice from a qualified and adept Muslim physician is highly recommended. This is evident from numerous religious works. This directive has been underscored by jurists across various contexts and suggests prudence and caution in all areas. For instance, if one anticipates illness or an extended recovery due to prostration, they are exempted from placing their forehead on the ground, should this be the directive of the physician. Similarly, those apprehensive about complications from fasting are required to consult medical experts before choosing to pay fidyah and abstaining from the fast.
