Question:

If the husband kisses the wife without passion during ihram, what penalty must he pay?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Allah Ta`ālā states:
“Hajj is [during] well-known months, so whoever has made Hajj obligatory upon himself therein [by entering the state of ihram], there is [to be for him] no sexual relations and no disobedience and no disputing during Hajj. And whatever good you do – Allah knows it. And take provisions, but indeed, the best provision is fear of Allah . And fear Me, O you of understanding.” (Qur’ān 2:197)

A person in the state of Iḥrām must abstain from all physical advances to his/her partner.  One must be conscious of the order of Allah and refrain from all intimacy.

If a person was to kiss his wife with passion, Dam will become binding.  However, if a person was to kiss his wife without passion spontaneously upon arrival or departure, Dam will not become binding.

Hence, in your scenario, as long as passion was not the driving force behind the kiss, dam will not become binding. [1]

[1]  وَأَمَّا الَّذِي يَرْجِعُ إلَى تَوَابِعِ الْجِمَاعِ فَيَجِبُ عَلَى الْمُحْرِمِ أَنْ يَجْتَنِبَ الدَّوَاعِيَ مِنْ التَّقْبِيلِ، وَاللَّمْسِ بِشَهْوَةٍ، وَالْمُبَاشَرَةِ، وَالْجِمَاعِ فِيمَا دُونَ الْفَرْجِ لِقَوْلِهِ عَزَّ وَجَلَّ {فَمَنْ فَرَضَ فِيهِنَّ الْحَجَّ فَلا رَفَثَ وَلا فُسُوقَ وَلا جِدَالَ فِي الْحَجِّ} [البقرة: 197] قِيلَ فِي بَعْضِ وُجُوهِ التَّأْوِيلِ: إنَّ الرَّفَثَ جَمِيعُ حَاجَاتِ الرِّجَالِ إلَى النِّسَاءِ.

وَسُئِلَتْ عَائِشَةُ – رَضِيَ اللَّهُ تَعَالَى عَنْهَا – عَمَّا يَحِلُّ لِلْمُحْرِمِ مِنْ امْرَأَتِهِ؟ فَقَالَتْ: ” يَحْرُمُ عَلَيْهِ كُلُّ شَيْءٍ إلَّا الْكَلَامَ ” فَإِنْ جَامَعَ فِيمَا دُونَ الْفَرْجِ أَنْزَلَ أَوْ لَمْ يُنْزِلْ، أَوْ قَبَّلَ أَوْ لَمَسَ بِشَهْوَةٍ، أَوْ بَاشَرَ فَعَلَيْهِ دَمٌ، لَكِنْ لَا يَفْسُدُ حَجُّهُ، أَمَّا عَدَمُ فَسَادِ الْحَجِّ؛ فَلِأَنَّ ذَلِكَ حُكْمٌ مُتَعَلِّقٌ بِالْجِمَاعِ فِي الْفَرْجِ عَلَى طَرِيقِ التَّغْلِيظِ.

وَأَمَّا وُجُوبُ الدَّمِ فَلِحُصُولِ ارْتِفَاقٍ كَامِلٍ مَقْصُودٍ، وَقَدْ رُوِيَ عَنْ ابْنِ عُمَرَ – رَضِيَ اللَّهُ تَعَالَى عَنْهُمَا – أَنَّهُ قَالَ: إذَا بَاشَرَ الْمُحْرِمُ امْرَأَتَهُ فَعَلَيْهِ دَمٌ، وَلَمْ يَرَوْ عَنْ غَيْرِهِ خِلَافُهُ، وَسَوَاءٌ فَعَلَ ذَاكِرًا أَوْ نَاسِيًا عِنْدَنَا خِلَافًا لِلشَّافِعِيِّ.

وَلَوْ نَظَرَ إلَى فَرْجِ امْرَأَتِهِ عَنْ شَهْوَةٍ فَأَمْنَى، فَلَا شَيْءَ عَلَيْهِ، بِخِلَافِ الْمَسِّ عَنْ شَهْوَةٍ أَنَّهُ يُوجِبُ الدَّمَ، أَمْنَى أَوْ لَمْ يُمْنِ، وَوَجْهُ الْفَرْقِ: أَنَّ اللَّمْسَ اسْتِمْتَاعٌ بِالْمَرْأَةِ وَقَضَاءٌ لِلشَّهْوَةِ فَكَانَ ارْتِفَاقًا كَامِلًا.

فَأَمَّا النَّظَرُ فَلَيْسَ مِنْ بَابِ الِاسْتِمْتَاعِ وَلَا قَضَاءِ الشَّهْوَةِ، بَلْ هُوَ سَبَبٌ لِزَرْعِ الشَّهْوَةِ فِي الْقَلْبِ، وَالْمُحْرِمُ غَيْرُ مَمْنُوعٍ عَمَّا يَزْرَعُ الشَّهْوَةِ كَالْأَكْلِ، وَذُكِرَ فِي الْجَامِعِ الصَّغِيرِ إذَا لَمَسَ بِشَهْوَةٍ فَأَمْنَى فَعَلَيْهِ دَمٌ وَقَوْلُهُ: ” أَمْنَى ” لَيْسَ عَلَى سَبِيلِ الشَّرْطِ؛ لِأَنَّهُ ذُكِرَ فِي الْأَصْلِ أَنَّ عَلَيْهِ دَمًا أَنْزَلَ أَوْ لَمْ يُنْزِلْ.
