Question:

Salaams I had a queries i needed advice on please
My husband gave me 3 talaqs whilst knowing i am on my period. I have been told this counts as divorce but as I was on my period when he said it does this period count? [Question Published as Received]

The Fatwa

In the Name of Allah, the Most Gracious, the Most Merciful

The Answer

The แนฌalฤq given during the state of a womanโ€™s menses is considered sinful but valid. Therefore, if a husband gave three แนฌalฤq during the menstruation of the wife they will be considered valid.

The Fiqh of the Answer

Imam al-Qudลซrฤซ (d. 428 AH) notes that the optimum period for giving divorce is outside a womanโ€™s menstrual cycle and should only be one or two. However, he further elaborates that if an individual was to give a แนฌalฤq during a womanโ€™s menstrual cycle or was to give three แนฌalฤq, then in both cases, the แนฌalฤq will occur albeit the person would be sinful.

Imam Ibn สฟฤ€bidฤซn (d. 1252 AH) notes that an individual should give แนฌalฤq outside of a womanโ€™s menses period. He further states that if an individual was to give it during the time of menses, then he would be sinful.

Imam Fakhr al-Dฤซn al-Zaylaสฟฤซ (d. 743 AH) states that the prohibition of issuing แนฌalฤq in menstruation is due to a reason extrinsic to แนฌalฤq, and that is why the แนฌalฤq is still valid. When an action is prohibited for external reasons, it can still be formulated. Imam al-Zaylaสฟฤซ (d. 743 AH) mentions the example of entering into a trade with a counterparty after they had already committed to trading with someone else (al-Sawm สฟalฤ Sawm Akhฤซ).

If there was something inherently and intrinsically impacting the formulation of แนฌalฤq, such as the แนฌalฤq of someone who lacked mental capacity, or the wording or attribution being deficient, the แนฌalฤq will not occur at all. Ibn Mฤzah al-Bukhฤrฤซ (d.616 AH) states that แนฌalฤq to a woman with whom you are not married at all will not occur.

Imam al-Bฤbirtฤซ (d.786 AH) states that the binฤ (basis) of this Masโ€™alah is on the idea that แนฌalฤq should occur in a แนฌuhr in which no relations have taken place. This is known as Aแธฅsan al- แนฌalฤq – the optimal method of issuing แนฌalฤq.This method has been deduced by the Imams of the Madhhab from the verses of the Qurโ€™an and the Prophetic narrations. This is optimal because the default in แนฌalฤq is that it is prohibited, as narrated by Ibn Mฤzah al-Bukhฤrฤซ (d.616 AH); แนฌalฤq is permitted due to genuine need, and therefore it will be restricted to scenarios of genuine need. Al-Maydฤnฤซ (d.1298 AH) states that แนฌalฤq is prohibited by default and permitted due to necessity as it severs Nikฤแธฅ, which is the means of attaining tremendous and significant worldly and otherworldly (โ€˜ฤ€khirah) benefits. Hence, when แนฌalฤq is only permitted due to แธคฤjah (need), there must be a reasonable Dalฤซl and indicator of a genuine need. Issuing แนฌalฤq despite having the ability to have relations with their spouse and enjoy their company indicates to an underlying genuine reason that has resulted in choosing แนฌalฤq over something clearly beneficial.

When it comes to แนฌalฤq in แธคayแธ, the circumstances and benefits are not the same as in แนฌuhr, and as such, there is no indicator that is clearly and objectively decisive (Murajjiแธฅ) indicating that the husband has a genuine need and reason to severe ties and break the marriage. Considering this, แนฌalฤq in menses is not out of need, rather it is driven by unjustified reasons, and such a situation should be remedied by Rujลซโ€™.

Imam al-Atqฤnฤซ (d.758 AH) explains how divorce is not a thing to be perpetually repeated, and was not legislated as such, rather the additional values and opportunities for divorce are there to allow a second chance at things, in case of regret and in case of realisations and learnings from hindsight. Therefore, it is not permissible for him to change this meaning for himself after the Sharฤซสฟah has considered it.

Another reason mentioned by the Fuqahฤ’ is that such a แนฌalฤq causes unnecessary harm to the wife, as this menstruation is not counted when counting three menstruation cycles. It is not counted as the Qurโ€™an instructs three Qurลซโ€™ (interpreted as แธคayแธ), and three complete menstruations cannot be counted when แนฌalฤq has occurred during one of them.
