Question:

If I use scented soap in Ihram, do I have to give damm? [Question published as received.]

The Fatwa

In the Name of Allah, the Most Gracious, the Most Merciful

The Answer

Using scented soap while in ihram does not constitute the damm penalty on condition that the soap is not excessively fragrant or overpowering. However, the usage of scented soap should be avoided.  If however, such soaps are used in the state of Ihram, one would be required to give the amount of Sadaqat al-Fitr in charity.

The Fiqh of The Answer

The usage of soap serves the purpose of achieving cleanliness and removing dirt, and not for the sake of fragrance. Therefore, it shall not be considered a fragrancing agent but rather a tool for cleansing. It should be noted that soap bars generally have minimal amounts of scenting components and primarily consist of  cleansing agents. Thus, it is not mandatory to pay a Damm penalty for using soap during Hajj or Umrah. However, one must discharge the amount of Sadaqat al-Fitr in charity as expiation for the removal of dirt during the state of ihram.

Though clear rulings from primary Fiqhī texts are scarce in this regard, some Fuqahā (jurists) have penned a distinction between Khitṭmīy (a cleaning agent) with an overpowering and lingering scent and one without such properties. These discussions have been recorded in Ghunyat al-Manāsik and other juristic writings, stating that a penalty is due on the former, but not on the latter. At this juncture, the Fuqahā have stated the need to compensate and atone this shortfall with an amount equal to the value given as Sadaqat al-Fitr.

Mullā ‘Alī al-Qārī (d.1014 AH) has categorically stated that the usage of water mixed with ušhnān does not constitute a Damm penalty. The ušhnān leaves and/or mixture, known as S. Rosmarinus was and still is often used by Bedouins for cleaning as a soap substitute.

Contemporary jurists such as Mufti Radhā Ul Haq and Mufti Abdur Rauf Sukharwī have also clearly stated that the use of soap results in a minor atonement in the form of a payment equivalent to Sadaqat al-Fitr.
