Is there an iddah for a woman divorced immediately after marriage?
The question, as received
I recently got married to a man from South Africa. I live in the UK. My father was in South Africa and represented me in the marriage. However, one day later, the man divorced me saying it will not work out. Do I have to observe iddat?
The answer
If a husband issues a divorce without having consummated the marriage or spending time alone with his spouse, then the woman will not have to observe the waiting period (iddah). Immediately upon divorce, she will be permitted to marry another person.[1]
Condition: No iddah applies only if the marriage was not consummated and there was no seclusion.

(أن المانع) ش: من الخلوة الصحيحة م: (إن كان شرعيا) ش: كالصلاة والصوم ونحوهما م: (تجب العدة لثبوت التمكن حقيقة) ش: أي لثبوت تمكنه من الوطء حقيقة بلا شك، ولكن لا يتمكن شرعا فدارت بين الوجوب وعدمه، فتجب احتياطا لجواز أنها لا تتأتى بالمانع الشرعي.
م: (وإن كان) ش: أي المانع (حقيقيا كالصغر والمرض لا تجب) ش: أي العدة م: (لانعدام التمكن) ش: من الوطء م: (حقيقة) ش: قال الأترازي: بيانه أن في كل موضع يتمكن من الوطء حقيقة لكن تمتنع لمانع يجب فيه العدة (البناية ج 5 ص 153 دار الكتب)
