Can multiple people sacrifice one sheep for Qurbani? [Question Published as Received.]
The answer
According to the Hanafi school, multiple people cannot discharge their obligation of Udhiyyah by sacrificing an eligible lamb or sheep as Udhiyyah. At most, this would be regarded as Nafl and rewarding, but not sufficient to discharge the obligatory Udhiyyah.
Fiqh basis
Ala al-Din al-Samarqandi (d.540 AH) notes that cows and camels can be split into seven parts due to their being clear evidence from the Prophet ﷺ. However, in regard to sheep or similar smaller animals, there is no such similar evidence. Without there being any evidence, the Qiyas would be that one animal equates to one person. The splitting of an animal into parts is something which is Ta’abuddi and a form of Istihsan, as only the Legislator can designate multiple shares in an animal. Extrapolating precisely seven shares is not something that ‘Aql (reason) can determinei. Imam Zayla’i (d. 743 AH) also states that cows and camels were specifically outlined and highlighted by the Prophet ﷺ with seven shares, and therefore somewhat of an exception. The remaining valid animals for Udhiyyah will remain according to the logic of Fiqh, Qiyas, and remain as one animal per headii.
Imam al-Tahawi (d. 321 AH) states that sheep cannot be split into different parts. Imam Abu Bakr al-Jassas (d. 370 A.H), whilst commentating on the above, does indicate to some opinions that exist in relation to small animals sufficing an entire household. However, he mentions that this is against the majority, and is not permissible for practice.
Some narrations mention the practice of the Prophet Muhammad ﷺ regarding Udhiyyah. Sayyida Aisha narrats that the Prophet ﷺ ordered a horned ram to be slaughtered and recited specific supplications. Jabir ibn Abdullah and Abu Sa’id al-Khudri also narrated instances where the Prophet sacrificed horned rams on behalf of himself, his family, and those among his Ummah (community) who did not offer a sacrifice.
However, scholars have interpreted these narrations differently. Some argue that these narrations are either abrogated or specific to a circumstance or another. Others state that this was a voluntary sacrifice and that it is permissible to share the reward of voluntary sacrifice with many.iii
A person can sacrifice an animal voluntarily even in the days of Udhiyyah. Qadhi khan (d. 592 AH) notes in his compendium that if an individual was to sacrifice two sheep during the days of Eid, the first would animal to be sacrificed would discharge his obligation whilst the second would be voluntary and a praiseworthy actioniv. This view is further corroborated by Hafiz al-Din al-Kardari (d. 837 AH) who further elucidates that if one individual was to perform many sacrifices, then after the first obligatory sacrifice, the rest would be deemed voluntary and praiseworthyv.
